Judicial Branch Out of Control

The Judicial Branch is Out of Control and assuming more and more power. In an alarming example of governmental overreach, the courts denied President Donald Trump his effort to institute a temporary ban on travel for seven nations coming into America. Forget the fact that the press has knowingly and completely misinterpreted the whole concept of this ban, concentrating just on the court, one must be stunned watching this. The Judicial Branch explains the meaning of the Constitution and laws passed by Congress, yet as of late, they have been consuming powers designated for the other two branches of government.

For years, courts all over this nation have been more of an activist making new laws, rather than being a pacifist interpreting them. Now, right here in the light of day, or more like 4 am EST, this branch of government is assuming executive powers and telling the nation’s chief executive he cannot control who is coming and going to and from our country. However, that is not what the law says.

A series of laws known collectively as the ALIEN AND SEDITION ACTS were passed by the Federalist Congress in 1798 and signed into law by President Adams. These laws included new powers to DEPORT foreigners as well as making it harder for new IMMIGRANTS to vote. However, there are even more laws on the books granting presidents the power to restrict people coming and going to the United States. President Trump cited a federal law giving him broad immigration authority when he issued his executive order which temporarily blocks refugees and immigrants from seven countries from entering the United States. One of the laws the Executive Branch cited gives the president “broad authority to deny entry to any alien or class of aliens” whom he deems detrimental to U.S. interests.

A 1952 law reads: “Whenever the president finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.” No court has ever reversed a presidential order that is based on that provision until now.

The court did not need to deny the Justice Department’s motion and ask for full hearings. I could go on and on citing laws. There are tons of laws that give the president the power to do what President Trump has done including 8 USC Sec. 1182(f):

“Any alien who the Secretary of State, after consultation with the Attorney General, or the Attorney General, after consultation with the Secretary of State, determines has been associated with a terrorist organization and intends while in the United States to engage solely, principally, or incidentally in activities that could endanger the welfare, safety, or security of the United States is inadmissible.”

There is only one explanation on why the courts have done this and that is Trump Derangement Syndrome. The blind hatred for President Donald Trump is spilling out into our roads and streets, bleeding all over the mainstream opposition media and now gushing out of our courts. Half of this nation cannot accept the latest election results for president and have seemingly gone mad. Somewhere in the midst of this Mad Hatters Convention and blocked streets and highways lay a republic that needs defending. It is time to politically resist the resistance. It is time to pick sides. What side are you on? Either you are people that think the rest of the world has the right to come and go to America as they please with little restriction or you believe in extreme vetting for security and peace of mind.

That ban by President Trump was not written perfectly and that list needs expansion for sure, but the president does have the power to do this. Any other interpretation of the law that denies that is false and politically motivated. If America wants to elect an odd or offbeat chief executive, then it is our right. It is not the right of the losing side to deny the law through their sycophants like the colluding media and now their brethren in the courts. It is time to resist the resistance.
